By purchasing a plan, you authorize ClassyAgent to charge your provided payment method on a recurring basis (monthly or annually, depending on your plan).

Setup fees, subscription payments, and service charges are non-refundable, except where required by law.

We reserve the right to change pricing or service structure with reasonable notice. Continued use after pricing changes constitutes acceptance.

4. AI and Automation Features

ClassyAgent uses third-party AI tools such as OpenAI and Google Gemini to power chat, voice, and automation services.

By using these features, you acknowledge that:

• AI-generated content may not always be accurate or appropriate.
• You are responsible for reviewing and approving outputs before using them in client-facing contexts.
• ClassyAgent is not liable for damages arising from reliance on AI-generated or automated responses.

5. Client Responsibilities

You are solely responsible for:

• Compliance with applicable marketing, data protection, and telecommunication laws.
• Obtaining any necessary consent from your leads or customers before sending automated messages.
• Ensuring that your content, data, and use of AI automations comply with relevant regulations (including CAN-SPAM, TCPA, and any industry-specific standards).

ClassyAgent provides tools but does not assume liability for how those tools are used.

6. Intellectual Property

All website content, branding, designs, scripts, and tools created by or for ClassyAgent remain the intellectual property of ClassyAgent LLC.

You are granted a limited, non-exclusive, non-transferable license to use the Services solely for your business use.

You may not copy, resell, modify, or distribute ClassyAgent's materials without written consent.

Any client data, lead lists, or business information shared with ClassyAgent will be treated as confidential and used only for fulfilling contracted services.

To the maximum extent permitted by law:

• ClassyAgent LLC and its affiliates are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill.
• Total liability under these Terms shall not exceed the amount paid by you to ClassyAgent in the 3 months preceding the claim.

All Services are provided "as is" and "as available" without warranties of any kind, express or implied.

9. Termination

Either party may terminate services at any time.

Termination does not affect payment obligations for services already rendered or subscription periods already billed.

ClassyAgent reserves the right to suspend or terminate access immediately for violations of these Terms or misuse of Services.

These Terms are governed by and construed under the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles.
